The agreement

Who you're contracting with.

aiwine.co.nz is operated by AIWine Ventures Limited, the licensed seller of the wine sold on this site. GST No. 148-900-086. When you place an order, your contract of sale is with AIWine Ventures Limited; partner wineries pack and dispatch the wine on AIWine's behalf. AIWine holds an off-licence under the Sale and Supply of Alcohol Act 2012 (see the footer for the licence holder, number and expiry, with a link to a copy of the licence).

By using the site or placing an order you agree to these Terms, our Privacy Policy and our Delivery, Discounts & GST terms, which form part of this agreement.

Eligibility

18+ to buy, by law.

You must be 18 years or older to buy alcohol in New Zealand. You confirm your age when entering the site and again at checkout.
It is an offence to buy alcohol on behalf of someone under 18. The person receiving a delivery must also be 18+ and may be asked for ID.
Wine on AIWine is sold by AIWine Ventures Limited under its off-licence (Sale and Supply of Alcohol Act 2012). The licence holder, number and expiry are shown in the site footer with a link to a copy of the licence.

Orders & pricing

Placing an order.

All prices are in New Zealand dollars and include GST. Delivery and discounts are explained in our Delivery terms.
Your order is an offer to buy. It is accepted when the winery confirms it. If a wine is unavailable after you order, the winery will arrange a refund of that item.
We take care with pricing, but if an obvious error occurs the winery may decline or cancel the order and refund you in full.
Payment is processed securely at checkout. We do not store full card numbers.

Your consumer rights

Protected by New Zealand law.

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Wine sold to you must be of acceptable quality and match its description.

Faulty or wrong wine — if a wine arrives damaged, faulty or not as described, contact us at hello@aiwine.co.nz and the winery will replace it or refund you. Please tell us within a reasonable time of delivery.
Change of mind — because wine is consumable, change-of-mind returns are at the winery's discretion and the wine must be unopened and in saleable condition. This does not affect your Consumer Guarantees Act rights.

Where you buy as a business for business purposes, the parties may agree the Consumer Guarantees Act does not apply, to the extent the Act allows.

Liability

Fair limits.

To the extent permitted by law, and without limiting your Consumer Guarantees Act rights, AIWine's liability for the platform is limited, and the supplying winery is responsible for the wine it sells and dispatches. We are not liable for delays outside our or the winery's reasonable control.
